Florida Bankers want Non-Judicial Foreclosures

Florida Bankers Push For Non-Judicial Foreclosures
The Florida Bankers Association (FBA), a lobbying group representing banking institutions across the sunshine state, has presented a new bill to Florida’s Congress aimed at accelerating the foreclosure process. The bill, ironically titled The Florida Consumer Protection and Homeowner Credit Rehabilitation Act, would shift state property laws and establish “non-judicial” foreclosures as early as July 1. The idea is simple: banks would be able to expedite foreclosures against defaulting homeowners by removing the court system from the equation. Judges would no longer rule on foreclosure cases, effectively eliminating the judicial process from foreclosure law.

There are some issues, both legal and practical, with installing such a system. The first glaring issue is the elimination of due process – a constitutional right to every Floridian. However, there are other states that have installed such a plan including Alabama, California, Georgia and Texas. Unlike the other 37 states who have adopted this “fast-track foreclosure authority”, Florida has historically had very powerful homeowner rights which would be in direct conflict with the idea of non-judicial foreclosures.

Some of the many points highlighted in the 53-page bill include:
Non-judicial foreclosures must conclude in no less than three months and no more than a year. With proper legal assistance, Florida foreclosures can take a year to 18 months to work through the courts. The new bill would mean banks can theoretically auction the home out from under you within 90 days.

The Florida Supreme Court's newly endorsed mandatory mediation for lenders and homeowners would effectively be revoked. The proposed bill provides only for informal meetings between creditors and debtors.

Even after homeowners are evicted, banks would still pursue them for unpaid mortgage debt. However, banks will waive that right if homeowners avoid trashing or stripping the house before the new owner takes over.

Clearly, the bill is very raw and still needs a lot of work, but the writing is on the wall – financially strapped Florida homeowners beware.
The FBA has a list of reasons why the bill makes sense including avoiding abandoned houses staying vacant for long periods of time, preventing further congestion of state courts, and assist cities dealing with increased urban blight. FBA president, Alex Sanchez, was noted as saying “We don’t want the property. We want to get a property out of the courts and sold to a productive Florida family.”

The bill, if passed, would apply to foreclosures filed after July 1, meaning cases already in the courts would not be removed. If you have any questions regarding this or any foreclosure related issue, please contact an attorney at Yesner & Boss, P.L. at 888-282-2110.

Hudson-Crews Lake Wilderness Park-Central Pasco & Gulf Railraod-Open to public for rides 2/13/10

Crews Lake Wilderness Park is home to the Central Pasco & Gulf Railroad. The Central Pasco & Gulf Railroad provides train rides to the public on the second Saturday of each month. Rides are available from 10am until 4pm and take approx. 20-25 minutes road trip. A donation of $1 per ride per person is suggested since the railroad gets no public funding and is building and expanding on donated funds. So come on out and take a ride: the kids will love it!

Info from their website (Click to go to website): The Central Pasco and Gulf (CP and G) is a 7 1/2" gauge railroad being constructed within Pasco County's Crews Lake Wilderness Park. The park is near Shady Hills in the north central portion of Pasco County Florida.

The railroad is based upon the Orange Belt Railway. which ran from Sanford to St. Petersburg through Pasco County. The major towns on the CPand ;G are named for stops/stations on its route.
The CP&G will be a point-to-point with approximately 15,000 feet of mainline track. The phase currently under construction, is approximately 1,500 feet long and is targeted to be completed in 2010. Drawings of the entire railroad and this first phase can be found on the Track Plan page of the website.

I recently met Ila at the Pasco Arts Fest. She was part of the Progress Energy Gallery and their presentation of local art and artists. Ila is a former art teacher: and now that she’s “retired”, she devotes her time to creating the most wonderful wearable art. Her card says she does paintings, hand weaving, and hanging wearables. Her boas are so pretty and frothy that you just want to keep touching them. She makes sweater, capes, purses and, of course, boas and scarves.

If you get a chance on Feb 20, the Garden Club tells me that it will be open from 10am-2pm so stop in; it's well worth the visit. It is located at 5754 Moog Rd., in Centennial Park. Centennial Park also houses the Anderson Home (also on the National Register of Historic Homes) and the Centennial Park Library.

Ice on pond in New Port Richey FL – Rare Sight

We woke up to 28 degrees on Sunday morning; I looked outside and our pond had ice on it and so did the birdbath. My husband, the sweetie, heated some water to take out and defrost the birdbath. However, he didn't want to go back out to take this picture so I put on my snowsuit and this is what I got.
Yes, it is ice. It was there again this morning but disappeared more quickly than it did yesterday. We are having a heat wave; it was 32 this morning and went all the way up to 44. I know all you guys up in the frozen north think we're wimps but really we are just not used to temps this low for a long period of time.

SPCA Suncoast-New Port Richey-Fannie adopted - now Roxanne needs a home.

Roxanne is an 8 year old black cat adopted from the SPCA Suncoast as a 2 year old. At originally that time, she came to us with only 1 eye and we do not know what happened to her. She was returned to us in November as her family was moving and could not take her. The family let us know that in 2005 Roxanne’s tail had gotten caught in a door and part of it had to be amputated. Despite all of these problems, Roxanne is an affectionate, cuddly cat who likes to be petted. She likes to play with catnip mice and feathers and, when she is happy, will kiss your nose. Roxanne doesn’t like to have her picture taken as she feels she isn’t very photogenic but, if you meet her in person, you will fall in love. She is at the SPCA Suncoast. We are located at 7734 Congress St, New Port Richey and our adoption hours are noon- 6 PM, Weds through Sunday. Because Roxanne is a Priority Pet, her adoption fee $50 is which includes spaying, micro chipping and up to date vaccinations. For more info go to http://www.spcasuncoast.org/

This gingerbread house is approx. 16ft high. Made fresh every year, it takes 1050 lbs of Honey, 800 lbs of flour, 600 lbs chocolate, 600 lbs powdered sugar, 180 lbs apricot glaze, 140 pints of egg whites, 35 lbs of spices. See the picture below for the porch details.
